The Presidential candidate of the Peoples Democratic Party (PDP) in the last general election, Abubakar Atiku has officially filed an appeal at the Supreme Court praying to nullify the judgement of the Presidential Election Petitions Court (PEPC) which upheld the victory of President Bola Ahmed Tinubu at the 2023 Presidential polls.
Atiku is asking the Supreme Court to set aside the rulings of the PEPC, saying that their decision did not reflect the true realities of the ground of his petitions.
The Presidential Election Petition Court had on September 6, 2023 declared that President Bola Tinubu and Vice President Kashim Shettima were validly Elected in the February 25th polls.
In an over 11 hour verdict presided over by Justice Haruna Tsamani, the tribunal held that the petitioners, Former Vice President Atiku Abubakar and Perter Obi, did not prove their allegations of non compliance with the electoral laws against the election.
The PDP Presidential candidate, in his appeal, maintained that the PEPC made a grievous mistake and injustice in its findings by declaring President Tinubu as the winner of the polls.
Atiku emphasised that the tribunal failed in fulfilling its mandate when it refused to nullify the presidential election on the grounds of non-compliance with the Electoral Act 2022.
According to him, the evidence before the Tribunal proved that INEC conducted the election based on grave and gross misrepresentation, contrary to the principles of the Electoral Act 2022, based on the doctrine of legitimate expectation.
