Lagos, Nigeria — Ousted Lagos lawmaker, Mudashiru Obasa, has taken legal action against the Lagos State House of Assembly and its new Speaker, Mojisola Meranda, contesting his removal from office.
Obasa, who was removed as Speaker on January 13, 2025, by 36 lawmakers while he was out of the country, argues that his dismissal was unconstitutional since it occurred while the Assembly was on recess.
In a motion filed on February 12, 2025, through his legal team led by Chief Afolabi Fashanu, SAN, Obasa is seeking an expedited hearing and an order to shorten the response time for the defendants to seven days. He is also requesting that his reply to points of law be filed within three days.
Obasa’s case hinges on the interpretation of sections 36, 90, 92(2)(c), 101, and 311 of the 1999 Constitution (as amended), alongside the Rules and Standing Orders of the Lagos State House of Assembly.
His motion challenges the legality of the Assembly’s proceedings during recess, arguing that legislative activities should not continue without the Speaker’s authorization.
“Public interest demands a swift resolution to prevent disruptions in the Assembly’s legislative functions,” the motion states.
As of the time of filing this report, the court has yet to set a date for the hearing.
