A Federal High Court in Kano has issued a temporary order preventing Governor Abba Kabir Yusuf of Kano from reinstating Emir Muhammadu Sanusi II until a final decision is made on a lawsuit challenging the reinstatement.
The court order also opposes the elimination of four emirates in the state: Bichi, Gaya, Karaye, and Rano. This decision follows the approval of a bill by the State House of Assembly on Thursday.
The court instructed all parties to maintain the current situation until the lawsuit filed by Sarkin Dawaki Babba and Aminu Babba-Dan’Agundi is decided. Justice Liman allowed the Plaintiff/Applicant to serve court documents on the 6th Defendant (IGP) in FCT Abuja.
The defendants named in the case include the Kano State Government, the State House of Assembly, the Speaker of the Assembly, the State Commissioner of Police, the Inspector General of Police, the Nigerian Security and Civil Defence Corps, and the Department of State Services.
The court directed that due to Constitutional and Jurisdictional issues, parties are to address the court during the hearing of the Fundamental Rights application set for June 3, 2024. An interim injunction was granted to prevent the Respondents from enforcing the Kano State Emirate Law Council (Repeal) Law.
The court ordered the parties to maintain the status quo before the bill was passed until the hearing of the case.
The Judge scheduled the next hearing for June 3, 2024. On Thursday, Governor Abba Yusuf announced the re-appointment of Emir Sanusi.
