Bianca Odumegwu-Ojukwu’s sons, Afamefuna and Nwachukwu, have requested to be included as parties in a 2011 lawsuit filed by Ogbonna Ojukwu and others against Ojukwu Transport Limited (OTL) and others, which was decided upon in 2018. The lawsuit, marked LD/794/2011, involved the possession of OTL’s properties in Lagos, including No 29 Oyikan Abayomi Drive, Ikoyi Lagos, with a warrant of possession executed by OTL in July 2022.
Afamefuna and Nwachukwu have now petitioned the court to be recognized as interested parties in the matter and to be excluded from the executed warrant, citing a 2022 judgment from a separate case (LD/1539/2012) where they were granted possession of 29 Oyikan Abayomi Drive and four other properties. They claim that their possession was protected by a restraining order until the harmonization of Ojukwu’s properties by OTL.
Alleging their unawareness of the case before Justice Oyebanji, the Bianca sons argue that it would be unjust for the matter to be decided without their involvement, as it directly impacts their interests. OTL, in response, has unified the management of its assets following the 2022 judgment and appointed Massey Udegbe and Co as its estate agent.
Of the properties in the 2012 suit by Bianca and her sons, OTL claims non-payment of rent for 12 years by Uche Obilor/West African Offshore Limited for 30 Gerard Rd, Ikoyi, and rent arrears since 2017 by Foursquare Gospel Church for 32a Commercial Avenue, Yaba. They also mention the police-sealed 4 Macpherson Rd, Ikoyi, the unoccupied 29 Oyinkan Abayomi Rd, Ikoyi, and the well-maintained 13 Ojora Rd, Ikoyi.
During a recent court hearing regarding their application for joinder, OTL representatives were present, while Bianca, her sons, and their legal team were absent. The case was adjourned to May 20, 2024, for further proceedings.
