Abuja, Nigeria — The Federal High Court in Abuja has fixed September 22 for the hearing of applications in a suit filed by the Osun State Government against the Central Bank of Nigeria (CBN) and the Accountant-General of the Federation over alleged plans to divert local government allocations.
The legal battle, which has heightened political tensions in Osun, revolves around control of council funds following the removal of APC-elected chairmen in October 2022. The PDP-led state government maintains that their sack was upheld by both the Federal High Court and the Court of Appeal.
At Monday’s session, vacation judge Justice Emeka Nwite adjourned the matter after listening to submissions. Osun’s Attorney-General, represented by Senior Advocate Musibau Adetunbi, is challenging the transfer of the case from the Osogbo Division to Abuja, insisting that the court lacks jurisdiction.
The state also asked the court to restrain the CBN from opening or maintaining accounts for the sacked APC chairmen and councillors, warning that allowing them access to allocations would undermine subsisting judgments. It further disclosed that it had filed a fresh suit at the Supreme Court against the Attorney-General of the Federation over his alleged involvement in the dispute.
Counsel to the CBN and the Accountant-General opposed the applications, urging the court not to delay proceedings, while counsel to the AGF, Chief Akin Olujimi (SAN), faulted Osun’s notice of discontinuance.
Justice Nwite adjourned to September 22 for the determination of all pending motions.
The case underscores the ongoing tussle between the PDP-led Osun government and the opposition APC over control of local councils and access to statutory federal allocations, a key source of grassroots funding.
