Kano Police Ignore Gov Yusuf’s Order to Arrest Deposed Emir

The Kano State Police Command has refused to comply with Governor Abba Yusuf’s directive to arrest the deposed Emir of Kano, Aminu Ado Bayero, citing legal constraints and a pending court judgment.

Governor Yusuf issued the arrest order early Saturday morning following the former Emir’s return to the state. However, the police have chosen to follow a court order that requires maintaining the status quo until a ruling is made on June 3, 2024.

At a press briefing, Commissioner of Police Muhammad Usaini Gumel confirmed the command’s adherence to the judicial directive. “We are complying with the court order that the status quo must be maintained until the court gives its judgment,” Gumel stated.

This legal impasse arises from a Federal High Court order in Kano issued on Thursday night. The court temporarily prevented the reinstatement of Muhammadu Sanusi II as Emir, following a lawsuit by Alhaji Aminu Bappa Dan Agundi, a prominent traditional leader. Justice A.M. Liman’s interim injunction suspended the Kano State Emirates Council (Repeal) Law, 2024, which aimed to abolish the emirates established under the previous administration.

The injunction restrains the state government and its agencies from enforcing the new law, thereby preserving the traditional structures until further court deliberation. Justice Liman emphasized the need to prevent further disruption until the matter is resolved.

Governor Yusuf has criticized the court’s intervention, alleging that Justice Liman issued the injunction while abroad. During a ceremony presenting an appointment letter to Emir Sanusi Lamido Sanusi, the governor expressed his intention to report the matter to the Nigerian Governors’ Forum, claiming judicial overreach.

The case is set for a hearing on June 3, 2024, where the focus will be on the fundamental rights application. The court has also directed that all relevant documents be served on the Inspector General of Police in Abuja to ensure due process.
